根据《中华人民共和国对外贸易法》第七条、第三十六条和第三十七条规定，2024年9月26日，商务部（以下称调查机关）发布商务部2024年第40号公告，决定就加拿大对自中国进口相关电动车辆和钢铝产品采取的加征关税等限制措施（以下称被调查措施）进行反歧视调查。
调查机关就被调查措施是否构成《中华人民共和国对外贸易法》第七条所规定的歧视性的禁止、限制或其他类似措施进行了调查。根据调查结果和《中华人民共和国对外贸易法》的规定，调查机关作出裁定（见附件1）。现就有关事项公告如下：
一、裁定
调查机关认定，加拿大相关被调查措施构成《中华人民共和国对外贸易法》第七条“在贸易方面对中国采取的歧视性的禁止、限制或者其他类似措施”，相关措施影响了正常贸易秩序，对中国造成严重负面影响。
二、反歧视措施
根据《中华人民共和国对外贸易法》和《中华人民共和国关税法》相关规定，采取反歧视措施，对原产于加拿大的部分进口商品加征关税。相关措施另行公告。
三、措施的调整
在出现以下情况时，上述措施可以按程序调整、中止或取消，包括：（一）被调查国（地区）政府已经调整或者取消被调查的措施或者做法；（二）被调查国（地区）政府已经就造成的损害向中国提供适当的补偿；（三）被调查国（地区）和中国通过磋商等方式达成一致解决方案；（四）被调查国（地区）政府进一步采取实质性措施；（五）其他适当情形。
四、本公告自2025年3月8日起生效。
