近期，市场监管总局公开的一组数据让我感到既振奋又熟悉:市场监管总局2025年共审查重要政策措施5.8万件，在全国抽查政策措施1万余件并督促问题文件完成整改。同时，市场监管总局向全社会公布了一批聚焦光伏、外卖、新能源汽车等领域的整治案例。这些信息清晰地传递出一个信号：整治“内卷式”竞争，正在从共识走向制度、从文件走向实践。 看到这些，我不禁回想起我在全国政协十四届三次会议期间提交的《关于综合整治“内卷式”竞争的提案》从酝酿到落地的全过程。2024年底的中央经济工作会议明确提出综合整治“内卷式”竞争。作为全国政协社会和法制委员会委员，我长期关注市场秩序与法治建设，对“竞争”与“法治”这两个词格外敏感。此次会议明确提出“内卷式”竞争，让我意识到，这不是一个简单的产业现象，而是一个关乎统一大市场建设和公平竞争秩序的深层次治理课题。会议一结束，我便有意识地将目光投向产业一线。 我先后走访了新能源汽车、光伏、电商平台、网约车等领域的多家企业，查阅了大量行业数据和司法案例。其中不少企业反映，尽管行业整体发展迅猛，但“价格战”愈演愈烈，其背后有一个共同的逻辑：以牺牲质量、创新和合理利润为代价，进行价格厮杀，并且往往伴随着滥用市场优势、挤压供应链、侵犯知识产权等行为。我越来越清晰地认识到，“内卷式”竞争的本质，往往是不正当竞争。 为了更广泛地汇聚各方智慧，我在上海市长宁区虹桥街道古北市民中心，专门组织了一场提案听取意见座谈会。会上，我与来自不同行业的企业代表、专家学者展开深入讨论。那场座谈让我更加坚定了判断：“内卷式”竞争伤害的不仅是某一个企业，而是产业链供应链韧性，是市场创新的元气，是消费者长远的福祉。整治“内卷”，必须从法治、信用、平台治理和社会监督多个维度打出组合拳。 带着调研中凝聚的思考，我在2025年全国政协十四届三次会议期间正式提交了《关于综合整治“内卷式”竞争的提案》，系统分析了“内卷式”竞争的主要表现与危害，并提出四方面建议：尽快完成反不正当竞争法修订，强化公平竞争审查刚性约束和执法监督；完善以信用为基础的制度性建设；进一步压实平台治理责任；加强针对垄断和不正当竞争的检察公益诉讼。 让我备受鼓舞的是，这件提案被遴选为全国政协十四届三次会议重点提案选题。同时，提案主要承办单位市场监管总局会同国家发展改革委、最高人民检察院进行了认真研究，并专门形成答复函。更令我感动的是，有关部门负责人还就提案中涉及的法律界定、监管难点和实施路径，与我进行了一个多小时深入务实的电话沟通。这种对委员建言的高度重视和认真态度，让我深受感动。 我欣喜地看到，一系列制度成果正在加速落地。新修订的反不正当竞争法正式施行，明确将平台经营者强迫平台内经营者以低于成本的价格销售商品、大型企业滥用相对优势地位拖欠中小企业账款等典型“内卷式”竞争行为纳入规制范围；价格法迎来首次修订，进一步健全了不正当价格行为认定标准、健全了价格违法行为法律责任；《公平竞争审查条例实施办法》进一步细化了对地方政府干预市场行为的审查要求。市场监管总局还围绕“新三样”、外卖平台、新能源汽车等重点领域，开展了专项整治，发布了十大典型案例和十大制度建设成果，形成了覆盖事前预警、事中监管、事后惩戒的全链条治理体系。 这些进展不是提案的终结，而是推动问题解决的开始。治理“内卷式”竞争不会一蹴而就。2025年底召开的中央经济工作会议再次提出深入整治“内卷式”竞争，政府工作报告明确2026年政府工作的重要任务之一是“深入整治‘内卷式’竞争”，今年4月召开的中共中央政治局会议同样强调，深入整治“内卷式”竞争。从“综合”到“深入”，一词之变体现了中央对“内卷式”竞争的精准判断，同时也体现了这项工作的长期性和艰巨性。 面对中央持续深化的部署，我深知作为一名政协委员，不能止步于提案办复。我将继续深入产业一线调研，依托政协平台建真言、献实策，助力整治工作不断向纵深推进。展望前路，随着法律体系更加严密、监管手段更加丰富、企业合规意识日益加强，我们有理由期待，市场竞争将从“卷价格”回归“卷质量”“卷创新”“卷服务”的良性轨道，让每一个守法诚信的经营主体，都能在公平有序的环境中蓬勃生长。（记者 周佳佳 采访整理） .md
