各有关单位： 为有效减少建设工程合同履约纠纷，维护发承包双方的合法权益，确保工程质量和安全，根据《深圳市建设工程合同管理办法》（深建规〔2025〕16号）第十条的规定，自2026年1月1日起发布招标公告（文件）的建设工程项目，招标人应当结合工程实际，以书面形式提示投标人合同中存在的风险（详见附件），风险提示作为招标文件的组成部分。投标人应当充分评估合同风险，对风险提示存在异议的应当在规定期限内提出。 招标人按上述要求书面提示合同风险后，无需再执行深建市场〔2019〕7号文件相关要求。 特此通知。 附件：关于建设工程合同的风险提示 深圳市住房和建设局 2025年12月24日
