2016年9月3日，第十二届全国人民代表大会常务委员会第二十二次会议审议通过《关于修改〈中华人民共和国外资企业法〉等四部法律的决定》，将不涉及国家规定实施准入特别管理措施的外商投资企业设立及变更，由审批改为备案管理。经国务院批准，外商投资准入特别管理措施范围按《外商投资产业指导目录（2015年修订）》中限制类和禁止类，以及鼓励类中有股权要求、高管要求的有关规定执行。涉及外资并购设立企业及变更的，按现行有关规定执行。<br>
