人工智能生成虚假内容、威胁个人隐私、加剧“算法黑箱”等,硬法是应对这些风险的传统规制工具。人工智能产生的风险具有快速弥散、动态难测的特点,而硬法缺乏灵活性、回应性以及规制对象过于僵化,无法独立胜任人工智能治理的任务。软法兼具灵活性、实验性以及多元主体合作等优势,与人工智能“善治”需求相适配。但软法存在规范性欠缺、权威性不足、约束力较弱以及执行无监督等缺陷。对此,应从创设、实施和监督等环节进行优化,包括健全支撑软法的硬法体系、提高软法质量、规范软法制定程序以及为软法提供执行保障机制等。
