Opinion of the Economic Crime Investigation Bureau of the Ministry of Public Security on Jurisdiction Issues in Non-State Functionary Duty Crime Cases
公安部经济犯罪侦查局关于对非国家工作人员职务犯罪案件管辖权问题的意见
This document clarifies that in cases involving non-state functionaries suspected of duty crimes, the public security organ in the location of the suspect's work unit has jurisdiction, and instructs local authorities to implement this accordingly.

（2003年4月21日 公经〔2003〕436号） 近来，有多地公安机关就非国家工作人员涉嫌职务犯罪案件，犯罪嫌疑人工作单位所在地公安机关是否有管辖权问题请示部经侦局。对于该问题，部经侦局曾于2001年3月正式批复，此批复征求过最高人民检察院研究室的意见，最高人民检察院研究室同意部经侦局意见，即非国家工作人员涉嫌职务犯罪案件中，犯罪嫌疑人工作单位所在地公安机关具有管辖权。现予网上公布，请各地参照执行。
