This document approves the exemption from withholding income tax on interest income derived by German Investment and Development Co., Ltd. from loans to Xiamen Jinxiong Enterprise Co., Ltd., based on the provisions of the China-Germany Double Taxation Agreement.

厦门市国家税务局：<br> 你局《关于对荷兰发展中国家金融公司及德国投资发展有限公司从我国取得的利息所得免征预提所得税的请示》(厦国税[2000]58号)收悉。关于德国投资发展有限公司从厦门进雄企业有限公司限得贷款利息免征预提所得税的问题，现批复如下：　　鉴于上述贷款是由德国投资发展有限公司提供，经德国税务主管当局证明，该公司系中德两国政府避免双重征税协定第十一条第三款第二项中的德国在发展中国家投资金融公司。经研究，同意对德国投资发展有限公司上述贷款取得的利息收入免征预提所得税。
